Sole Proprietorship, General Partnership, or “Operating As” Name

To operate a business in Ontario using anything but your own legal name, you must register with the Province of Ontario. If you want to register a sole proprietorship, general partnership or an “operating as” name for an existing corporation, you can register online on the Service Ontario Website. SBEC staff are available Monday to Friday from 8:30 to 4:00 to assist with registrations.

Registration information required includes the proprietor’s (and/or all partners) name (s) and home address (es), type of business, business address and major activity. Existing corporations registering an “operating as” name will require an incorporation number. It will take you approximately 20 – 30 minutes to complete the registration.

Registration costs $60, as well as $8 for each optional name search. The Centre accepts Visa, MasterCard, and American Express. The Orangeville & Area SBEC office can no longer receive cash or cheque as payment in the office. You may register with cash payments at locations in Guelph, Barrie and Brampton.

Incorporation

Businesses wishing to incorporate in Ontario must deliver written articles of incorporation with the proof of a NUANS name search and appropriate filing fee to an approved Province of Ontario office.  The closest office is the Land Registry Office located in Barrie or 393 University Avenue in Toronto. A registration fee of $360 made payable to the Minister of Finance is applicable. Although it is not required, it is recommended that a lawyer, accountant and/or an incorporation specialist firm be used to incorporate, since it can be a complicated procedure. This also assures that the owners and directors are familiar with all of the legal and reporting requirements of a corporation, and their personal responsibilities.
